1. Acceptance of Terms

By accessing or using AI Headshot & Face Swap ("the App"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the App.

2. Description of Service

AI Headshot & Face Swap is an application that enables users to create AI-generated avatars and face-swapped images using their uploaded photos. The App processes user content through advanced AI models hosted by third-party providers.

3. User Accounts

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to keep it up to date.

4. User Content

Your Photos: You retain full ownership of the photos you upload. By uploading, you grant us a limited, temporary license to store and process the photos solely to train a personalized AI model and generate results for you.

Generated Content: You may use the AI-generated avatars and face swaps for personal, non-commercial use. Any commercial usage may require a separate agreement or license.

5. Prohibited Uses

You agree not to use the App to:

Upload photos of others without their explicit consent
Upload photos of minors without parental/legal guardian consent
Create or distribute content that is illegal, harmful, violent, hateful, harassing, or misleading
Impersonate any individual or misrepresent your identity
Upload content containing nudity, sexually explicit acts, or graphic violence
Violate the rights of others, including privacy and intellectual property rights
Reverse-engineer or tamper with the app, its APIs, or underlying AI models
Use the App for any fraudulent or unlawful purpose

6. Intellectual Property Rights

The App, including but not limited to its software, code, design, models, and UI, is protected under applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the App or its components.

7. Third-party Services

The App may use external services (e.g., AI model training providers, image hosting) to operate core features. You agree that your photos may be processed by these services solely for the intended feature, under strict confidentiality and data deletion timelines.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THE APP.
